These Terms of Use (the "Terms") govern your access to and use of the website at unpaved.com (the "Website") and the mobile applications published by Unpaved LLC ("Unpaved", "we", "us", or "our") (each, an "App", and together with the Website, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Services. By using the Services, you represent that you meet this requirement.
2. Use of the Services
You agree to use the Services only for lawful purposes and in compliance with these Terms. You agree not to:
- Use the Services in any way that violates any applicable law or regulation;
- Attempt to gain unauthorized access to any portion of the Services, accounts of other users, or systems or networks connected to the Services;
- Interfere with or disrupt the operation of the Services, including by introducing viruses, malware, or other harmful code;
- Reverse engineer, decompile, or attempt to extract the source code of any App, except to the extent that such activity is expressly permitted by applicable law;
- Cheat in, exploit, or otherwise manipulate the multiplayer or competitive features of any App; or
- Use any automated system to access the Services in a manner that sends more requests than a human could reasonably produce in the same period.
3. Accounts and content
Some features of the Services may require an account or may allow you to submit content (such as player names, game data, or messages). You are responsible for any content you submit and for activity that occurs under your account. We may remove content or suspend accounts that violate these Terms.
4. Intellectual property
The Services, including all software, designs, text, graphics, and other content (excluding user-submitted content), are owned by Unpaved or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.
5. Purchases and subscriptions
Some Apps offer in-app purchases or subscriptions. All purchases are processed through the platform you use (such as the Apple App Store) and are subject to that platform's terms. Refunds and billing disputes are handled by the platform, not by Unpaved, except as required by law.
6. Third-party services
The Services may rely on or link to third-party services. We are not responsible for the availability, content, or practices of any third-party service.
7. Disclaimer of warranties
The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
8. Limitation of liability
To the maximum extent permitted by law, Unpaved and its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Services.
9. Indemnification
You agree to indemnify and hold Unpaved harmless from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of your use of the Services or your violation of these Terms.
10. Changes to the Services and to these Terms
We may modify, suspend, or discontinue the Services (in whole or in part) at any time. We may also update these Terms from time to time. If we make material changes, we will update the Effective Date above and, where appropriate, provide notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
12. Governing law
These Terms are governed by the laws of the United States and the state in which Unpaved LLC is organized, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in that state, and you consent to the jurisdiction of those courts.
